Andrea Marie Wheatley, 1 Injured in Truck Accident in El Paso County, TX

EL Paso, TX — September 28, 2023, Andrea Wheatley and one other were injured due to a semi-truck accident at around 10:00 a.m. on Gateway West.

In their preliminary statements, authorities say that the collision happened near the intersection of Gateway West and Stetson Drive.

According to officials, 37-year-old Andrea Marie Wheatley was in a Nissan Sentra which was going westbound on Gateway. Up ahead, it appears a semi-truck moved into the left inside lane, then began to make a right turn across the outside lane. As it did so, it entered the path of Wheatley's vehicle, and the vehicles collided.

Due to the collision, Wheatley had apparently incapacitating injuries. A passenger in the Nissan reportedly had non-incapacitating injuries. Authorities recommended a charge

I've litigated many truck accident cases, and I struggle to recall a single situation where authorities blame a driver that's traveling in their lane when another vehicle cuts into their lane of travel. Now, could there be a scenario where the driver who was cut off is the one at fault? Sure, but they're really rare. I can't help but wonder if police got this one wrong.
