I certainly don't know more than anyone else in the public about this crash, but I do have experience with accidents where someone is said to have "incapacitating injuries". One of my biggest concerns in those situations is to what degree the victim was incapacitated and whether or not they got to tell their side of the story.

If authorities arrive on the scene, and the victim is unconscious or was already taken to the hospital, they may only base their story on whatever the other driver says. They typically follow up later on, but sometimes the victim simply slips through the cracks, and no one is asking them for their view of what happened.

I can only hope that's not what happened here and that authorities made sure to speak with the victim rather than tell a one-sided story.
