Esmerada Ponce, Julio Ponce Guerrero Injured in Truck Accident in Kimble County, TX
Kimble County, TX -- February 1, 2023, Esmerada Ponce and Julio Ponce Guerrero were injured after a semi-truck accident.
Investigations placed the crash in the area of US Highway 83 mile marker 464 at around 8:18 a.m. It appeared that 65-year-old Julio Ponce Guerrero and 33-year-old Esmerada Ponce were in a Nissan Titan traveling southbound along the highway. From oncoming lanes, it appears a tractor-trailer lost control on icy roads, going into the southbound lane and hitting the pickup.
Ponce had injuries said to be incapacitating while Ponce Guerrero's injuries were non-incapacitating. Police did not give additional details about the crash.

It's just a shame to see a vehicle lose control on icy roads which should ostensibly be driven by a professional who knows how to drive in inclement conditions. Maybe there were extenuating factors here, but even authorities seem to believe that this was entirely avoidable. But that rarely stops companies from making excuses to avoid responsibility for those avoidable decisions. It would just baffle people to see some of the excuses I've had to deal with in accidents like the one described here.
Not long ago, for example, there was a crash involving a tractor trailer that lost control while it was raining, causing a serious head-on collision. The trucking company swore up and down that it was just too slick for anyone to avoid the crash. Well, our reconstruction showed that flimsy excuse for what it was.
Not only was it just a light rain at the time of the crash, but data from the truck's ECM proved it had been going fast enough that it may have lost control even on dry roads. That's mostly due to the fact that our analysis showed the truck's tires to be worn and far past the point of needing to be replaced. It was only after all of that the company accepted they had no grounds for their excuses, and they cooperated with the victim's loved ones.
I can only hope that any company possibly involved in this crash actually takes some responsibility if their driver made a mistake, but I also hope the authorities understand the importance of gathering as much clear evidence as possible to anticipate those companies who do the exact opposite. Whatever happened here and whatever comes next, these preliminary details are likely far from telling the whole story.
