Commentary on Jamaine Henderson Alleged Drunk Driver Accident in Dallas
I talk to victims and families all the time about crashes involving alcohol--in fact I've handled more such incidents than just about any other firm in the state. What always gets to me is just how many of those people were surprised when I would ask if police found out where the driver got their alcohol. Why would that matter? Well, simply put, those businesses may also need to be held accountable.

Texas dram shop law says that an alcohol provider who over-serves an obviously intoxicated person can be liable for damages resulting from that intoxication. Especially considering those businesses would likely otherwise continue putting lives at risk, it just makes sense to give people the right to confront those businesses for their actions.
Despite how vital a tool this is for Texans, I rarely ever see authorities or other professionals in my line of work talking about it. That's why I try to address incidents like this as much as possible. Even if dram shop turns out not to apply to any given crash, it would be irresponsible not to ensure it got thorough attention as soon as possible from experienced investigators.
