Commentary on Alleged DWI Accident on Highway 155 in Tyler

UPDATE (November 15, 2022): It is encouraging to see that authorities are actually looking into an alcohol provider here. Whether or not they're innocent, these are crucial possible factors to consider, just as I discussed below. However, the priority authorities have is to consider criminal charges and administrative penalties. Their interests rarely align with dram shop, which is why there still may need to be independent investigations to fully address the mistakes surrounding this tragic event. Considering authorities are already looking into the same establishment for other incidents, I'd say looking into this business should be a top priority.

ORIGINAL: Anytime authorities bring up alcohol as a possible factor, it's crucial to look into the factors leading up to the crash. It's possible there's an accomplice to all of this that also needs to be held accountable, and they may even be responsible for the victim's injuries.

This is due to dram shop law. It says that an alcohol provider who over-serves an obviously intoxicated person can be liable for damages resulting from that intoxication. If a bar over-serves someone and that results in people getting hurt, dram shop can get help for victims and ensure that all responsible parties are held accountable. Since authorities don't often look into this on their own, there may need to be more thorough independent investigations here to bring all the facts to light.
