Robert Voglesong Jr. Injured in Car Accident on Boat Club Rd in Fort Worth, TX

Fort Worth, TX — October 29, 2022, Robert Voglesong Jr. was seriously injured in a crash with a suspected drunk driver on Boat Club Road in Fort Worth.

Authorities say the incident happened around 10:20 p.m. on Boat Club Road at Bailey Boswell Road. Preliminary investigation suggests Voglesong's Acura RSX was stopped on southbound Boat Club at the Bailey Boswell intersection.

A Toyota Camry approached from behind the Acura and rear-ended it, pushing it into the intersection. After the impact the Toyota driver continued southward and crossed into the oncoming lanes where they were stopped by a witness.

Voglesong suffered serious injuries in the collision. The Toyota driver was reportedly unhurt.

Investigators suspected the striking driver was intoxicated and collected blood samples for testing.

Commentary on Robert Voglesong Jr. Accident in Fort Worth

If blood tests confirm alcohol was involved here as police believe, some may think that just means the alleged drunk driver will be charged accordingly. That's important, of course, since DWI drivers put themselves and others at risk and should face serious consequences. However, I would argue (and the law agrees) that the same is true of everyone who had a hand in the damage done, which is why it's important to talk about Texas dram shop law.

Under dram shop law, licensed alcohol providers who over-serve an obviously intoxicated person may be liable for injuries they cause or suffer while under the influence. Anyone hurt by one of these accidents deserves all the help they can get; a dram shop claim against a negligent bar is one way to seek it. Furthermore, it makes sure the offending business faces consequences for endangering its customers and the public with illegal over-service.

Not every alcohol-related wreck involves a dram violation, and to be clear I'm not pointing fingers at any Fort Worth businesses. The source of an alleged DWI driver's drinks is just an important detail to work out during a full investigation. Unfortunately police rarely look into possible dram violations, so if an alcohol vendor may have contributed to the crash then it may be best to seek proof of that independently. With the right help and evidence, many folks have held bad bars accountable for the serious damage they helped cause.
