Sumant Nepal Injured in Car Accident off State Highway 183 in Irving, TX

Irving, TX — October 14, 2022, 29-year-old passenger Sumant Nepal was seriously injured in a single-vehicle accident off State Highway 183 in Irving.

Authorities say the incident happened around 5:55 p.m. on the Highway 183 service road near Cheyenne Street. Preliminary investigation suggests Nepal was riding in a Toyota Camry heading west on the service road when the vehicle went out of control for unknown reasons and hit a nearby guardrail.

Nepal suffered serious injuries in the crash and was taken to an area trauma ward. The driver and other passenger of the car were unhurt.

Investigators noted a suspicion that the car's occupants, including the driver, were under the influence of alcohol.

No further information is available at this time.

Commentary on Sumant Nepal Accident in Irving

If investigators find clear evidence confirming the driver was impaired, some might think the only thing left to do is charge him accordingly. It's important that drunk drivers face consequences considering the terrible damage they often cause, but I also believe that everyone responsible for the injuries dealt in a DWI crash should be held accountable for their part. That's why it's important to know about Texas dram shop law.

Under dram shop law a licensed alcohol vendor (bar, nightclub, restaurant, store, etc) that sells or serves drinks to an obviously intoxicated customer may be responsible for any injuries that person causes or suffers while under the influence. Holding law-breaking bars accountable for over-service is crucial for protecting drivers and communities, and the victims of that recklessness deserve a chance to confront those businesses in court and seek help with their recovery.

Having said all that, alcohol is only a theory unless evidence ultimately shows otherwise. If police don't plan to look much further (including checking for a potential dram shop violation), maybe independent investigators should step in to be sure the whole story is learned and the victim gets the help he deserves.
