Jacky Gaschot Killed in Alleged Intoxicated Driver Accident in Austin, TX

Austin, TX -- November 4, 2022, Jacky Gaschot was killed following an accident which allegedly involved intoxicated driving.

Investigations said that the incident happened at approximately 5:22 p.m. along East Riverside Drive near I-35 and South Congress Avenue.

It appears that 62-year-old Jacky Gaschot was walking at the time when a sedan hit Gaschot in a series of events not made clear. It appears another pedestrian was also hit.

Gaschot died due to the incident while the sedan driver, identified as Crystal Dominguez, and the unidentified pedestrian were taken to area hospitals.

Police allege that Dominguez was intoxicated at the time, and charges for intoxication assault and intoxication manslaughter are pending.

With accusations like these, there obviously needs to be serious consideration both for what consequences are appropriate and what can be done for the victims and families involved. Those answers are likely to be a lot more complex than people may realize. This is due to the possibility that both a driver and a negligent alcohol provider played a role in the deadly crash.

In Texas, dram shop law says that an alcohol provider who over-serves an obviously intoxicated person can be liable for damages resulting from that intoxication. That means if a bar illegally over-serves someone such that they're a clear danger to themselves and others, the bar bears some responsibility for whatever harm results from that over-service.

This is vital to consider for a few reasons. One, quite simply, is because it can help the victims and families during a time of incredible hardship. Most anyone can appreciate that. The other reason, though, is ensuring there is accountability. Drunk drivers have their day in court. Families are left to pick up the pieces. So why should a law-breaking business get off scot-free? Dram shop seeks to remedy that, and I know from experience how effective it can be in that regard.

With all of this said, dram shop is not the sort of thing authorities tend to look into on their own. They've clearly taken steps to address the allegations that a driver here was intoxicated. There may need to be more thorough independent investigations to ensure others involved also answer for their role in someone's death.
