Commentary on Pedestrian Accident off I-35 in Austin

Folks tend to write off accidents between pedestrians and vehicles, saying "either the victim was in a crosswalk or they were at fault." Things are seldom that cut-and-dried when investigators take a closer look, and considering how few details preliminary reports have it sure seems like they need to here.

The accident could indeed be a simple if tragic matter of someone on foot where they shouldn't be. However, what if they were in a crosswalk? What if the area was so well-lit that they were unmistakably present as the vehicle approached? Could they have been changing a tire near a disabled vehicle? There could even be extenuating circumstances to consider if either party in the crash was impaired at the time, since that could mean a local business violated dram shop law and would need to answer for its part in the damage done.

Must things be more complicated than someone walking through or in the road at a bad time? No, but neither can other possibilities be ignored without proper consideration. At the end of the day, the evidence needs to speak for itself. That won't happen if folks jump to conclusions and then refuse to budge. The victim's loved ones certainly deserve better than that.
