Commentary on Julian Ruiz Mendoza Car Accident in Caldwell County
If it's true that alcohol led to this crash, then hopefully steps were taken to ensure there were appropriate consequences. But this can mean a lot more than simply charging a drunk driver. There could be an accomplice that authorities often overlook: a local bar.
Texas dram shop law says that an alcohol provider who over-serves an obviously intoxicated person can be liable for damages resulting from that intoxication. Other establishments such as restaurants, liquor stores, and gas stations have those same rules to follow. If their negligence causes harm, those harmed have the right to confront that business and hold them accountable. In doing this, dram shop is a vital tool for assistance which families may not have otherwise had access to.
