Commentary on Joshua Chavez Accident in Levelland

Investigators mentioned a suspicion that the victim of this crash was intoxicated. That should always be taken seriously and they took blood samples for testing, but unless the results come back positive it's important not to take their suspicion as fact. These situations can be a lot more complicated than a few sentences in a report make them sound.

Driver mistakes like intoxication, fatigue, and distraction must be considered after a wreck like this, but so too should less-common possibilities like vehicle failures or defects, medical emergencies, road hazards, other drivers who left the scene, etc. Even in alcohol-related crashes there are extenuating factors to look into, like where the alcohol came from. Depending on the answer to that a local business may be liable for the victim's injuries under dram shop law.

Unfortunately, having found an explanation they favor police may not broaden the investigation into those other areas. That's why I often suggest that independent investigators have another look and ensure no blanks are left unfilled. The victim deserves the benefit of the doubt until then.
