Bobby Allen Killed in Car Accident on Highway 146 in Dayton, TX

UPDATE (November 15, 2022): Sources have identified the man killed in the accident as 73-year-old Bobby Allen. Authorities have yet to confirm a cause for the crash.

Dayton, TX -- October 31, 2022, one person was killed following an accident where multiple vehicles crashed on Highway 146.

Authorities said that the incident happened at around 7:30 p.m. along the 5900 block of Highway 146, near the BNSF Dayton Yard.

According to local and Liberty County officials, the incident happened as a GMC Yukon was pulling out of a driveway along the northbound lanes of the highway. Doing so, a northbound Infiniti SUV crashed with the GMC. The Infiniti ran off-road while the GMC crashed with other vehicles.

Details say that the Infiniti driver sustained fatal injuries. It's unclear if anyone else was hurt. Police have not said what other factors may be involved, saying drugs and alcohol have not yet been ruled out.

Frankly, in a state like Texas, alcohol should be considered after any crash, even if it's just to rule it out. But something stands out to me here. Looking at this stretch of road, there appears to be at least one drinking establishment. Could it be that the vehicle pulling onto the highway was leaving that venue? And if so, does that change things?

A crucial reason to consider possibly complicit establishments is dram shop law. Simply put, dram shop law says that an alcohol provider who over-serves an obviously intoxicated person can be liable for damages resulting from that intoxication. Our legislature recognized the need for victims and families both to get the help they need and to see that negligent alcohol providers were held accountable for their actions. Dram shop, when handled by experienced professionals, can do both of these things.

So when I see details like these, I can't help wondering if the incident is getting the attention it deserves. A vehicle pulls onto a highway, a deadly multiple vehicle wreck occurs, and there's a bar mere feet from the crash site? Investigations may very well show that alcohol wasn't a factor at all or that there were no outside parties involved, but it would be outright irresponsible not to let the evidence speak for itself.
