Roxana Carpio Injured in Single-Vehicle Accident on Fondren Rd in Houston, TX

Houston, TX — August 7, 2022, 33-year-old Roxana Carpio was seriously injured in a single-vehicle accident on Fondren Road in Harris County.

Authorities say the incident happened around 7:50 a.m. on Fondren near Main Street. Preliminary investigation suggests Carpio was driving a Toyota Corolla south on the roadway when she lost control for unconfirmed reasons. The car ran off the right side of the road, jumped two curbs, and crashed into a ditch.

Carpio suffered serious injuries in the wreck. Investigators believed alcohol consumption was involved and administered field tests which showed she had an approximate BAC of .137.

Breathalyzers tend not to be as definitive as blood tests, but even allowing for their margin of error it seems police believe intoxication was a factor here. That may mean the victim will have a day in court some time down the line, but that's not my place to talk about. Instead, I think it's better to look at ways to help her get back on her feet. One such way would start with finding out where her drinks came from.

Under Texas dram shop law, an alcohol provider that over-serves an obviously intoxicated customer may be liable for injuries caused by that person while they're under the influence. If the Houston victim was over-served somewhere (perhaps the Saturday night before) and her intoxication was the reason for her crash, the business that provided her alcohol may have a duty to help with her injuries.

You'd never know it by the way some of them act, but alcohol providers have a legal responsibility not to over-serve people. When they do and people get hurt, they law says they have to help those victims. Most bars follow the rules and not every DWI wreck involves a dram shop violation, but the possibility should be looked into when alcohol use seems to be tied to serious injuries. Bad bars should face serious consequences and the people affected by their recklessness deserve all the help they can get.
