Thor Smith Injured in Auto Accident on I-35 in Austin, TX

Austin, TX — September 17, 2022, 36-year-old Thor Smith was seriously injured in a traffic accident on Interstate 35 in Travis County.

Authorities say the incident happened around 2:25 a.m. on I-35 southbound near Oltorf Street. Preliminary investigation suggests Smith was driving a Toyota Tacoma south on the highway when for unknown reasons he rear-ended a blue sedan in the middle lane. Reports say both drivers swerved left in an unsuccessful effort to avoid the crash. Afterward the sedan left the scene; the car's make and model are unknown.

Smith suffered serious injuries and was taken to a hospital. Investigators suspected intoxication played a part in the collision.

I can't speak to whether police suspicions about alcohol are correct here. If they are--meaning clear evidence confirms them--that may have further implications under Texas dram shop law, which says people hurt in a DWI accident (even the alleged drunk drivers) may be entitled to help from any bar that over-served them drinks.

Having said that, though, I'm not making any accusations or presumptions. There's a lot of reasons someone might rear-end another vehicle unintentionally, and things like bad road conditions and vehicle failures must be accounted for as well. Moreover, police must do what they can to track down the driver that fled the scene and find out why they did so. In some cases they have something else to hide, but even if not they should answer for leaving another person injured in the road.

All I'm really saying is that this wreck like any other deserves full and careful investigation to be sure its whole story is learned. It's one thing to say "one vehicle hit another" and another entirely to understand exactly how and why that occurred. In the meantime the victim deserves the benefit of the doubt and any help he can get with his recovery.
