Commentary on Maria Casas Ramos Accident in El Paso

Reports say the accident victim consented to a blood draw so officers could find out whether their theories about alcohol held weight. However, just because they suggested that was possible doesn't make it automatically the case; as such, ignoring other possible explanations would be irresponsible. What if the car had mechanical issues or defects? Did it blow a tire? What were visibility and road quality like in the area? Did the driver have a medical emergency and lose control?

Even if alcohol really was a factor things could still be more complex than they seem. Texas dram shop law says that any business that over-served the victim if she was obviously intoxicated may actually be legally responsible for her injuries in that crash. Nothing like that may have happened in El Paso, but are police considering that during their investigation? Unfortunately, I doubt it.

Without more thorough efforts, there's no telling what authorities may have overlooked. That's why it's best folks learn about other possible factors and ensure someone gives them all proper attention. At the very least it's best to be sure the truth is the only thing left at the end of the investigation.
