Damian Buendia Injured in SUV Accident on Ohio Ave in Dickinson, TX

Dickinson, TX — August 13, 2022, 19-year-old Damian Buendia was seriously injured in an auto accident on Ohio Avenue in Dickinson.

Authorities say the incident happened around 9:40 p.m. on Ohio Ave near Farm to Market Road 1266. Preliminary investigation suggests Buendia was a passenger in a westbound Cadillac Escalade. The SUV's 18-year-old driver allegedly failed to maintain a single lane and ran off the road into a ditch. It continued in the ditch until it hit a culvert and briefly went airborne, then hit a parked Chevy Corsica in a driveway.

Buendia suffered serious injuries in the crash. The Cadillac driver received minor injuries.

Police mentioned a suspicion that the young driver who crashed that Cadillac was under the influence of alcohol. That's a concerning thought for any intoxicated driver, but the possibility of an underage one being at all impaired is even more troubling--and could have further implications if a local business sold that young man his drinks directly. If so it could be in some hot water for serving underage customers, but it might also be liable for the injuries dealt to his passenger in the crash.

This is due to dram shop law, which says that an alcohol provider who over-serves an obviously intoxicated person may be liable for damages resulting from that intoxication. In my experience, any business reckless (or at least inept) enough to serve an 18-year-old is unlikely to draw the line at over-serving him while they're at it. If a business did that and someone got hurt, that establishment may have a duty to make what amends it can for the part it played in the victim's injuries.

So did authorities look into the events preceding this crash? The answer to that could reveal a local business that needs to be taught a harsh lesson, and in the process an injured young man could potentially get some much-needed help getting back on his feet.
