Commentary on Motorcycle, Truck Accident on Taft Vineland Road in Orange County

I'm going to be rather blunt here. The most recent images of this intersection I can find show that traffic along Taft Vineland has no traffic control at General Drive nor around any of the nearby private lots. If that's indeed the layout at the time of this incident, did this truck simply fail to yield to an oncoming motorcyclist? It sure seems like it, but folks can't take that kind of information for granted. Not only could there be extenuating circumstances to consider, but there are also likely challenges that need to be overcome if a victim's loved ones are actually going to get the resolution they deserve.

One thing to consider, for example, is the fact a lot of people are biased against motorcyclists. Simply because they're a motorcyclist, people are generally more likely to believe claims that the victim was speeding, weaving through traffic, driving without lights, or doing something else reckless. Few understand this as well as trucking companies and insurance companies whose only priority after a crash like this is to avoid responsibility.

To be clear, though, I don't bring this up to fearmonger or to make a situation like this seem hopeless. I've handled plenty of cases where companies did everything in their power to exploit biases. Each time, their efforts proved fruitless in the face of clear evidence and solid legal strategy. It's one of the reasons I talk about deadly wrecks like this. People need to understand how important it is they seek out experienced professionals to tell their side of the story as soon as possible. Simply taking police statements on their own isn't likely to produce a fair resolution.

Hopefully steps are being taken here to tell this victim's side of the story. Like I said, I can't say what happened here, but these initial details are beyond troubling, to say the least. In the meantime, folks can consider what I've said here and more examples of potential challenges I've outlined in the article below.
