Carrollton, VA -- October 10, 2022, James Edward Bailey was killed due to an accident where a moped hit a commercial truck.

Investigators responded to the area of Brewers Neck Boulevard and Bartlett Circle at around 3:15 p.m.

It appears that James Edward Bailey was on a moped traveling along Brewers Neck. Ahead, authorities say that a delivery truck was improperly stopped along the road with its hazards on. Somehow, Bailey's moped crashed into the truck.

Bailey sustained fatal injuries due to the collision. Right now, additional details are unavailable.

I certainly can't say without more thorough investigations, but I can say from experience just how crucial proper investigations will be. Put simply, Virginia has laws which inherently benefit trucking companies and insurance companies. It makes it easier for them to shift blame onto victims regardless of what kind of evidence they may or may not have.

While not insurmountable, those barriers can prove significant without the right evidence and legal strategy. Are steps being taken here to ensure the evidence can tell the victim's side of the story? If left solely up to the authorities, my concern is there won't be enough weight to balance the scales and ensure those affected by this tragedy get a fair fight for the resolution they deserve.
