Commentary on Pedestrian, Truck Accident on Cambridge Street in Boston

With pedestrian incidents, folks aren't always clear on how complex they can be. It's not always as simple as just finding out who had the right-of-way. There's also the matter of finding out how reasonably avoidable the pedestrian was.

If, for example, a pedestrian is in the middle of the highway, that is certainly dangerous, and they shouldn't be there. But if they're well lit and easy enough to avoid, a driver doesn't have free rein to run them down just because they have the right-of-way.

In photos from this particular scene, this appears to be an urban area where one might expect to see pedestrians, even late at night. So was this a matter of a pedestrian failing to look for traffic, or was this a driver not paying attention to their surroundings? Further investigations will likely bring more facts to light to get those answers.
