Luis Armando Santana Valero Killed, 1 Injured in Car Accident in McAllen, TX

McAllen, TX -- September 18, 2022, Luis Armando Santana Valero was killed and one person was hurt after a car accident.

Investigations indicated that the incident took place at around 6:00 a.m. along Highway 107 near Bensten Road.

It appears that 38-year-old Luis Armando Santana Valero was in a Nissan Altima traveling westbound on the highway. The driver apparently lost control, causing the car to run off-road, then hit a tree.

Valero sustained faal injuries as a result of the crash. The driver, unidentified at this time, was said to have incapacitating injuries.

Police say they believe alcohol was a factor in the crash. They say charges are pending. This and other details have yet to be confirmed.

Any mention of alcohol raises red flags. No doubt there will be consequences if evidence confirms that it was indeed a factor. But that's not just in reference to potentially drunk drivers. After a tragedy like this, the victim's loved ones also deserve to know if some local establishment contributed to the fatal crash.

In Texas, bars, restaurants, and other venues have a legal responsibility to avoid serving anyone who is obviously intoxicated. If they do so, and that leads to people getting hurt, that establishment can be held liable under dram shop law for their role in the accident.

I've helped hundreds of families affected by similar accidents, and it would shock folks to see how little regard some businesses have for the well-being of their communities and even their own customers. Did over-service contribute to this deadly crash? I can't say without more thorough investigations, but I can say from experience how families in these situations deserve every opportunity to get answers and to see those responsible for their hardships held appropriately accountable.
