Caine Rivera Injured in Single-Vehicle Accident on FM 476 in Atascosa County, TX

Atascosa County, TX — September 8, 2022, 28-year-old Caine Rivera was seriously injured in a single-vehicle accident on FM 476 in Atascosa County.

Authorities say the incident happened around 4:50 p.m. on FM 476 near mile marker 536. Preliminary investigation suggests Rivera was driving a Ford F-150 pickup north on the roadway when the truck reportedly blew a tire. Rivera lost control and swerved through the roadway, then left it to the east and the truck overturned. It came to rest upright facing west on the roadside.

Rivera suffered serious injuries in the accident. Investigators at the scene detected signs of intoxication and arrested Rivera on suspicion of DWI. Blood samples were collected for testing.

It seems like there's quite a bit to unpack after this accident, but even as police wait for blood test results to say whether the driver was impaired or not I can see two areas that could probably use further investigation.

The first would likely depend on the results of those tests: If it's confirmed the victim was intoxicated and that was a contributing factor to the crash, then Texas dram shop law says any business that served him too many drinks may be liable for his injuries. If so, that would mean it has a duty to help him get back on his feet. Hence, the source of the alcohol should be identified during the investigation.

The second issue is unrelated to alcohol: If the pickup's tire blew out as described, then someone should look into exactly why that happened. People tend to blame most blowouts on debris in the road, but common as that is it's not the only explanation. For instance, the tire could have been defective; if so, its manufacturer could be liable for the victim's injuries, but just as importantly it needs to do something about recalling and replacing its faulty product on other vehicles to prevent further damage.

Some may roll their eyes and say I'm overcomplicating things in search of a "bad guy," but both the issues I mentioned have the potential to cause a great deal of harm above and beyond the damage done to the victim in this accident. A reckless bar left unchecked puts its community in danger with over-service, and a tire manufacturer cranking out bad products potentially puts thousands of people at risk of unpredictable blowouts and crashes. I don't think it's wrong to want both carefully considered; my concern is whether police will do that or just content themselves with arresting the driver and giving the matter no more thought.
