Kevin Hinojosa Killed in Truck Accident in Kennewick, WA

Kennwick, WA -- September 26, 2022, Kevin Hinojosa was killed following an accident where a truck and a car collided.

Investigators were called to the crash scene at around 6:30 p.m. along US Highway 395 at mile marker 18.

It appears that 27-year-old Kevin Hinojosa was in a car traveling southbound on US 395. Hinojosa stopped due to a prior collision. While he was stopped, a semi-truck somehow crashed into Hinojosa's vehicle.

Hinojosa sustained fatal injuries due to the crash. No other injuries were mentioned by authorities. Charges may be pending at this time.

To be rather blunt, it's highly unlikely this sort of thing happens without a truck driver messing up big time. While it may have been getting dark, visibility shouldn't be an issue in the waning hours of rush hour. There was clearly a line of vehicles, including the victim, that had no issues slowing down. So what was different for the truck driver?

Could this be some one-in-a-million, unforeseeable incident the truck driver couldn't avoid? Sure, but the more likely explanation is simply that the truck driver was going too fast, following too closely, or not paying attention to the road. As easy as that is to say, though, it's important victims and families can actually provide clear proof. There will no doubt be professionals on the other side doing everything in their power to push the narrative in their favor.

One of the biggest mistakes I see from people--including less experienced attorneys--is assuming a situation like this is straight-forward. They see a truck rear-end someone and figure it's clear as day the truck driver is at fault. But as long as there are possible explanations to blame the victim or someone other than the truck driver, there is room for the trucking company to shift blame off of themselves.

As such, having as much clear evidence as possible is vital in getting to the heart of the matter. Accident reconstructionists need to be able to map out the scene, pull ECM data, check cell phone and GPS records, pull maintenance history and any possible history of reckless driving the truck driver has, information about past incidents with that particular trucking company, etc. Frankly, authorities rarely go that deep, which is why I'm always so adamant about more thorough independent investigations.

At the end of the day, someone lost their life here. My priority would not be to look for someone to blame but rather to get the facts. They'll ultimately show where the blame lies while also serving as a foundation with which to get a grieving family the answers and the help they deserve.
