Montgomery County, TX — September 23, 2022, a male pedestrian was struck by at least two vehicles and killed on Interstate 45 in Montgomery County.
Authorities said only that the incident happened shortly before 10:00 p.m. on southbound I-45 near Farm to Market Road 1488. Preliminary investigation suggests the victim was trying to run across the freeway when he was struck by two or more vehicles and suffered fatal injuries. Commentary on Montgomery County Pedestrian Accident on I-45
It seems like there's no real telling what happened here yet. Some may think things can't be that complicated if a pedestrian was hit on a busy highway, but few accidents are really as simplistic as the news makes them sound.
It may be risky for someone to be on foot on an interstate, but that doesn't make pedestrians "fair game" for drivers there. The law expects everyone to avoid any accident they reasonably can, so if investigation found either driver was doing something that prevented them from reacting appropriately they could be at least partly at fault whether or not they had the right-of-way.
On the other hand, if evidence shows the drivers had no reasonable way to avoid the victim then it would be unfair to hold them accountable for what happened. There are still questions about visibility, distraction, speeding, what the pedestrian was doing, and many others that need to be resolved before saying one way or the other whether the wreck could have been avoided.
