Commentary on Vanessa Gonzalez Alleged DWI Accident in Randall County
Anytime details like this surround a serious accident, folks tend to assume everything will be open-and-shut. A driver was drunk, so they'll be held responsible. What more is there to discuss? Well, perhaps nothing, or perhaps there's an accomplice police are overlooking. Someone with my experience always knows to ask: Where did the driver get their alcohol, and were they illegally over-served?
According to Texas dram shop law, an alcohol provider who over-serves an obviously intoxicated person can be liable for damages resulting from that intoxication. No only can this be a vital source of assistance for victims and families, it's also a way to ensure a negligent business is held accountable for their actions before they cause more harm to the community. Whether or not authorities ever looked into that here remains to be seen.
