Woman Killed, 1 Injured in Nightclub Shooting in Port Arthur, TX

Port Arthur, TX -- September 18, 2022, one person was killed and one was injured due to an accident where a shooting occurred at a club.

Emergency services responded to a nightclub in the area of Houston Avenue and Rev Dr Ransom Howard Street at around 3:30 a.m.

Right now, the exact circumstances are unclear. It appears shots occurred at the French Connection nightclub, and two people were shot. Both were taken to area hospitals where one of the victims, identified as a 32-year-old woman, succumbed to her injuries. No further information about the incident is available at this time.

Obviously in these situations there needs to be consequences for the suspect. It doesn't taken an attorney to explain all that. But I get a lot of calls about incidents like this one where folks have another question: What responsibility, if any, does the business bear? As usual, the answers is: It depends.

Businesses generally owe a duty to keep visitors safe and to seek out, remedy, or at least make explicitly known hazards which could harm visitors. Most folks understand that with puddles or loose wires, but do shootings really count? They can in certain circumstances.

A random episode of violence is not something most businesses can reasonably foresee or prevent. But some businesses become such a hotbed of violence and crime that failing to take steps to lessen those incidents or otherwise ensure visitors know they're at risk can make them liable for future incidents. Could this be one such incident? It would take a lot more thorough investigations to say that for sure.
