Commentary on Rashad Jones Car Accident in McLennan County

With details as concerning as alcohol being in one of the cars, it's important folks understand why that can actually make things more challenging in a lot of situations. While it may seem like things would be more straight-forward, since a drunk driver would clearly be in the wrong, it can raise additional obstacles because there could also be a local alcohol provider involved.

Texas dram shop law says that an alcohol provider who over-serves an obviously intoxicated person can be liable for damages resulting from that intoxication. Bars, liquor stores, gas stations, restaurants--businesses have rules to follow. Failure to follow those rules means people get hurt, and that's reason enough for the law to provide the tools victims and families need to get some help. Maybe it won't be a factor in this particular crash, but more thorough independent investigations may be necessary for ensuring all responsible parties are being held appropriately accountable.
