Commentary on Kelly Grogan Accident on I-10 in Beaumont

I've noticed over the years that folks tend to write off incidents like this one much too quickly. Their general thought is that pedestrians shouldn't be on highways for essentially any reason, full stop. Fortunately the law takes a more nuanced view; whether a pedestrian should be on the highway or not, they're not "open season" for passing vehicles and everyone--particularly a professional driver--has a legal duty to avoid any accident they reasonably can.

That's why it's important to learn all the specifics: What are sightlines and visibility like in that area? Was the truck driver awake, alert, and watching the road? Were the rig's lights on and working? Could or should the driver have done anything differently? If the victim didn't notice the approaching truck, why not? Where did he come from at 4 a.m., and where was he headed? Are there witnesses or video footage that can shed more light on what happened?

Those questions aren't meant to complicate things or make accusations; further investigation might show this is a simple matter of unfortunate timing. However, it could also reveal other issues that weren't considered at first. At the very least the victim's loved ones deserve to know that careful attention to detail was exercised to learn the whole truth. If there's anything else to do besides that, knowing so will depend on what that truth turns out to be.
