Pedestrian Killed in Truck Accident on NW 87th in Kansas City, MO

Kansas City, MO -- September 13, 2022, one person was killed after an accident where a commercial truck hit a pedestrian in Zona Rosa.

In initial accounts, police officials said that the incident happened in the Zona Rosa area off NW 87th Street and NW Prairie View Road at around noon.

It appears that a pedestrian was crossing the roadway at the time when a dump truck attempted to make a left turn. Doing so, the truck hit the pedestrian. It's unclear who had the right-of-way at the time.

Due to the collision, the pedestrian succumbed to fatal injuries. At this time, no further information is available.

With an accident like this, folks are quick to assume it's all down to who had the right of way. That's important, of course, but there's something folks should keep in mind.

This is clearly a busy shopping area with plenty of stores and restaurants. Even on a Tuesday, noon in a place like this is sure to see a lot of foot traffic. While this collision appears to have happened on the relative outskirts of the shopping center, I have little doubt that any reasonably prudent driver would be unaware of how many pedestrians were around them.

Was this truck driver equally attentive? Did factors beyond the driver's control lead to this? Did the victim simply step off the curb at the wrong time? Or, would a more attentive driver have seen and avoided the pedestrian, regardless of who had the right-of-way?

It shouldn't take an experience attorney to explain why those are important questions to answer, but it may require more experienced professionals to actually get those answers.
