Kevin Martinez Nunez Killed in Alleged Intoxicated Driver Accident in Fort Worth, TX

Fort Worth, TX -- August 28, 2022, Kevin Martinez Nunez sustained fatal injuries due to an accident allegedly involving an intoxicated driver.

Investigators said that the incident happened sometime after 2:00 a.m. in the area of Stalcup Road and East Berry. There appeared to be a previous fatal crash in the area, creating a roadblock. Family said that 21-year-old Kevin Martinez Nunez was in a vehicle attempting to detour around the crash scene. While doing so, another vehicle slammed into Martinez Nunez's vehicle.

As a result of the crash, Martinez Nunez succumbed to fatal injuries. As of September 9, authorities said they are charging the other driver for intoxication manslaughter. They identified that driver as Darron Phillips. Right now, additional details are unavailable.

It's always so tragic to see allegations like this, especially when those alleged actions take someone's life. If true, there will no doubt be consequences for those actions. But who all is really accountable? Depending on what happened here, there may yet be an accomplice to all of this which still needs to be held accountable: a bar.

According to dram shop law, an alcohol provider who over-serves an obviously intoxicated person can be liable for damages resulting from that intoxication. Establishments flippantly breaking the law and putting lives at risk obviously puts the community in danger. So why shouldn't they be held accountable for their actions just as drunk drivers are accountable for theirs?

A big reason I'm so concerned about that possibilities here is due to the initial crash blocking the roadway here also may have involved intoxicated driving. This issue is a serious one here in DFW and in Texas as a whole. Families out there deserve to get the full story, and they deserve any opportunity afforded to them by Texas law to confront those responsible for their hardships. Are proper steps being taken here to get answers and ensure there are appropriate consequences for the victim's death?
