Commentary on Devin Gerloff Accident near Sioux Center

There's obviously more investigation to do here, but if investigators are right about the general details of what happened then it seems like the commercial truck driver failed to yield. Traffic on Fig Avenue has a stop sign and vehicles on B-40 don't, so if the big rig got in the pickup's way some may see that as clearly the commercial driver's fault. At that point those folks may assume he and his employer will have little choice but to do the right thing and help the victim with his injuries.

That may seem reasonable, but I often caution people against thinking an accident--especially one with a commercial truck--is as straightforward as the news might suggest. I also urge them not to take a trucking company's cooperation for granted, no matter how damning the preliminary details may seem.

Frustrating as it is, trucking companies rarely accept fault without doing everything they can to avoid it first. Some may not see how that'd be possible here if the truck driver didn't yield, but it's important not to underestimate how stubborn trucking companies and their attorneys will get to avoid liability and protect their assets.
