Commentary on Alexis Lopez Accident in Houston
It's obviously concerning when police say alcohol might have been a factor in a crash. If they confirm their suspicion with blood tests or hospital records, that may mean the injured woman has some legal consequences on the horizon. However, it's important to know that she may not be the only one to hold accountable for the damage done in this crash.
If alcohol's involvement is confirmed, then it would be important to find out whether a local bar illegally over-served the driver. If so, they could be liable for the injuries she caused--even to herself--under Texas dram shop law. With that said, however, independent investigations often show police got something wrong or overlooked certain factors.
Alcohol's only one reason someone might rear-end a van on the highway, so I hope investigators will exercise due diligence and consider other possibilities as well. That's one of the reasons I always suggest independent investigations by experts with the time and training to get the whole picture. I doubt this incident would be the exception.
