Commentary on San Antonio Pedestrian Accident on Loop 410

Pedestrian accidents can be complex despite many people thinking they aren't. I've heard "Either they were in a crosswalk or they were at fault" more times than I care to count, but every accident--including those with pedestrians--must be carefully investigated and all their details uncovered.

For instance, there are still many questions to resolve. Why was the pedestrian there at the time? Where did she come from and where was she headed? What about the driver? How long was the victim in the roadway before the car passed through? How visible was she? Could the driver not see her running through all the travel lanes before she reached the ramp area? Is the highway lit up at night? Were the car's headlights on? Was the driver awake, alert, and paying attention? Did other vehicles avoid the pedestrian without issue?

I'm not accusing anyone of anything or saying I know more than reports offer. I'm only saying what I so often do: Even if preliminary reports seem fairly straightforward, it's always best to evaluate all the possible factors in search of the whole truth. If there are extenuating factors to consider, that will only be learned by finding all the details.
