Commentary on Elkhorn Driver 18-wheeler Accident on I-90/94/39 in Madison

While I never jump to conclusions without more thorough investigations, it seems pretty darn likely that the truck driver made a mistake here. I've handled hundreds of commercial vehicle wrecks over the years. Ninety-nine times out of a hundred, this sort of thing is the result of distracted driving, speeding, or following too closely. Is it possible something unusual like a mechanical defect occurred? Sure, and experienced accident reconstructionists would be able to confirm or rule that out. But regardless of whatever caused the wreck, those involved need to take steps to anticipate the potential barriers between them and the resolution they deserve.

Put simply, even a seemingly straight-forward fact pattern can be incredibly complex with a commercial truck wreck. That's due to companies having every incentive to avoid responsibility as much as possible. They have teams of professionals dedicated to doing just that, and their work typically begins the minute they get the call about the crash. Victims and families are best served understanding these tactics so they know to seek out experienced allies who can prepare for and overcome those challenges. Are those steps being taken here?
