Klara Lamatova Injured by Alleged DWI Driver on Fredericksburg Rd in San Antonio, TX

San Antonio, TX — July 25, 2022, 28-year-old Klara Lamatova was seriously injured in a crash with an alleged DWI driver on Fredericksburg Road in San Antonio.

According to reports the incident happened around 10:40 a.m. on Fredericksburg near Balcones Heights Road. Preliminary investigation suggests a Mazda 3 was traveling north on the roadway as a Chevrolet K1500 truck and Lamatova's Honda CB750 motorcycle were southbound nearby.

Reports say the Mazda driver lost control of his vehicle and swerved left of center, then hit both the Chevy and the Honda.

Lamatova suffered serious injuries in the crash. No other major injuries were reported.

Investigators suspected the crossover driver was intoxicated and drew blood samples for testing.

Commentary on Klara Lamatova Accident in San Antonio

Some might think that whatever punishments the courts dish out to the wrong-way driver after this accident would essentially be all the consequences anyone should expect. However, while it may provide some moral satisfaction to see a bad actor punished those charges do little to help the victim get back on her feet. That's why it's important to consider the bigger picture and whether anyone else should be held accountable for their part in the wreck.

For example, police strongly suspect alcohol was a factor. If blood tests confirm that, the wrong-way driver may not be the only one responsible for the damage done. If a local bar or other alcohol vendor over-served him before his drive and the wreck, that business may be liable for the victim's serious injuries under Texas dram shop law. If so, the business would have a legal duty to help her recover from her injuries.

Despite how important it is to stop law-breaking bars from endangering communities, I've learned over the years that police don't look too hard for dram shop violations. If a bar or other vendor may have contributed to the Fredericksburg Road crash by over-serving the crossover driver, then it may be better to seek proof of that independently. Armed with the evidence professionals find on their behalf, many people hurt by bad bars have held them accountable for the damage they helped cause.
