Commentary on Adam Alvarez Rollover Accident in Midland

Alcohol obviously stands out in reports like this, but I want to be clear I'm not saying that to criticize the victim. On the contrary, details like this make me wonder if someone out there contributed to this tragedy who has yet to be held accountable.

Adam Alvarez Killed in Rollover Accident in Midland, TX

At 5:00 a.m., drunk driving accidents aren't quite as common as they are in earlier hours around when bars close. Accidents are 5:00 a.m., then, often involve someone drinking at a residence. However, it's also possible that a bar can illegally over-serves someone so much that they go home, go to sleep, then wake up still too drunk to drive.

In those situations, it's virtually guaranteed the establishment broke the law by serving the victim. That means they can be liable for the resulting harm under dram shop law. Not only can this get people some much needed help, but it can also help hold those businesses accountable for harming their community.

Whether or not anything like that happened here isn't for me to say without more thorough investigations. I simply want folks to understand that there can be answers out there for families. They just need allies who know what to look for and what to do with those answers once they find them.
