Commentary on Jasmine Henry Car Accident in Arlington

Alcohol tends to catch one's eye anytime it comes up in a report, but it may not seem to important when authorities allege it was a pedestrian potentially under the influence. In reality, that can still be complex. To be clear, it's possible alcohol wasn't involved here, and I'm certainly not out to blame the victim. On the contrary, I can't help wondering if some local business is the reason this woman didn't make it home to her family that night.

Something important to consider with reports like this is dram shop law. Let me give an example. A while back, a family came to me about their loved one who walked onto a freeway where a car hit and killed him. It was unusual behavior, so they felt they weren't getting the whole story. Through our investigations, we found police overlooked something crucial.

It turned out the man had been drinking at a bowling alley on a night out with friends. That bowling alley illegally over-served him beyond the point of obvious intoxication. As a result, his intoxication led to him becoming disoriented while walking home, and he ended up walking into a dangerous place that ultimately cost him his life.

In other words, a man trying to do the right thing by walking home instead of driving lost his life because a business simply didn't care about his safety. That's why things like dram shop exist. It allows families to get the help they need while holding negligent establishments accountable for contributing to tragic events like this. Maybe investigations will show nothing like that happened here, but it's important to ensure a victim's loved ones are getting the answers they deserve.
