Commentary on 18-wheeler Accident on US 281 in Bexar County

Reports like these seem pretty straight-forward, and I certainly can't think of many situations like this I've handled where it turned out the truck driver wasn't in the wrong. But just because the facts seem clear doesn't mean there aren't extenuating circumstances to consider. Particularly, anticipating potential blame-shifting can be crucial for victims and families after any truck wreck.

For example, I had a case not long ago where an 18-wheeler cut someone off on the highway, leading to a serious collision. While it was clear the truck driver screwed up, their company denied responsibility, instead blaming the victim. Why? According to them, the victim was speeding and not wearing their seatbelt.

Since it was our burden to prove otherwise, we were able to conduct independent investigations to overcome that ridiculous defense. Not only did physical evidence and a frozen speedometer prove the victim wasn't speeding, but also EMS responders testifying they actually had to cut through the victim's seatbelt thoroughly sank that defense. It was only after all that the company finally started to cooperate.

The fact of the matter is even flimsy defenses can prove effective if left unchallenged. Here, there's the added hurdle of the driver of the car being a teenager, meaning folks are more likely to believe claims of them being reckless regardless of the evidence. Making sure there are clear answers about how all of this happened will no doubt be crucial in getting the folks affected by this crash the answers they deserve.
