Commentary on Dallas Motorcycle Accident on Central Expy

I've already seen some commenters taking note of the late-night/early-morning time the crash happened and saying the rider was intoxicated. While it's true that alcohol is often behind early-morning single-vehicle accidents, it is neither right nor fair to assume the worst of the victim as the investigation continues.

If evidence eventually confirms the rider was intoxicated, however, that still might be complex than people realize. Texas dram shop law says that an alcohol vendor like a bar or nightclub may be liable for someone's injuries if they over-served that person before an accident. If that happened in Dallas the victim's family would have the right to hold the business accountable for its role in the crash.

Common as it may be, though, intoxication is far from the only explanation for the accident. Someone still needs to look into other possible causes: Vehicle malfunctions, a blown tire, slippery roads, even another vehicle that ran the bike off-course and then left the scene--these and many other issues could have played parts, so until more facts are available it's best not to make guesses from the sidelines.

Until sufficient clear evidence is found to tell the whole story, there's still a lot of work to do. In the meantime the focus should be on how best to help the victim's loved ones through a difficult time.
