Carrizo Springs, TX — July 13, 2022, 60-year-old Jessie James Oshel was injured in a crash with a commercial truck on State Highway 85 in Dimmit County.

According to reports the incident happened around 2:00 p.m. on TX-85 at Farm to Market Road 1407. Preliminary investigation suggests an International semi-truck was towing a trailer south on FM 1407 and stopped at the TX-85 stop sign. Nearby, Oshel was driving a Dodge Ram 2500 with an attached trailer west on the highway.

Reports say the semi-truck driver failed to yield the right-of-way and pulled onto the highway, blocking the lanes as the Dodge approached. The pickup crashed into the left side of the semi-trailer.

Commentary on Jessie Oshel Accident in Carrizo Springs

It sounds from reports like the truck driver failed to yield and caused this crash, but neither he nor his employer are required to agree with reports. Long experience in this field has taught me they're more likely to say something else was more directly responsible for the crash and the victim's injuries. They might point fingers at low visibility, sudden and unforeseeable problems in the truck, or even the victim's own actions (speeding, distracted, "faulty evasive maneuvers") as the true cause of the damage.

I'm not saying that to indict the whole trucking industry, and I don't have specific reason to think the company would give the victim flak rather than own up to its driver's mistake and make things right. However, I can say without exaggeration that in decades of working on commercial vehicle crashes I have encountered just one company that took responsibility without a fuss. The overwhelming majority of them did everything they could to put hurdles in the way and protect their assets rather than help the victims who deserved it.

The specifics of truck accidents may vary, but even if they look clear-cut on paper victims should be ready for resistance and foot-dragging if they approach the company afterward. Preparing for that means gathering abundant clear evidence of what happened, but that can be tough while folks are struggling to get their lives back on track after a wreck. To help them take swift action I often recommend they work with independent investigators. Armed with what those experts find, many people are able to hold the right parties fully accountable for the damage done.
