Two Injured in Shooting off NW Loop 410 in San Antonio, TX

San Antonio, TX -- July 22, 2022, two people were injured due to a shooting outside of a bar along NW Loop 410.

Authorities reported that the incident happened in a parking lot outside of Ojos Locos at 5809 NW Loop 410.

At around 10:46 p.m., police say there was a car club meeting, and people were doing donuts in the parking lot. One person reportedly went to a driver to tell them to stop when that driver began firing shots at that person.

Due to the incident, one person was shot in the leg while another went to the hospital due to shrapnel. Details about the shooter are unavailable, and it's unclear what other factors may have contributed to the incident.

I get calls from people about shootings like this which occur on a business's property. They often want to know if that business is responsible. Put simply, they can be, but it depends on how foreseeable it is.

It wouldn't really be reasonable for a business to go around checking every person for gun and constantly having eyes on people, especially out in the parking lot. Ultimately, there's only so much someone can do to prevent a sudden altercation. That said, there are examples of businesses with a history of violence failing to take the necessary steps to make the property safer for their customers. As such, if failure to reasonably address known issues leads to people getting hurt, that business can be on the hook.

These reports mention a nearby business, but to be clear, I have no evidence they had anything to do with all of this besides simply being a nearby business for the news to include as a way to provide some context. That said, the listed address is for that particular establishment, and records show they've been the subject of several TABC investigations over the past few years. Maybe that's all happenstance, but it could be worth finding out if a more responsible business could have taken steps to prevent something like this.
