Commentary on Pedestrian Accident on North Freeway in Harris County

Authorities believe that the alleged intoxication here was a coincidence and that the accident was caused by the pedestrian in the road. I have no particular reason to doubt this, considering that's a generally dangerous place for someone to be. But further investigations could reconstruct the conditions and show whether or not a sober driver could have avoided the collision. If they could have, then perhaps intoxication is more significant a factor here than initial reports let on.

One particular reason that's so important is dram shop law. A lot of establishments in Harris County over-serve customers with no regard for anyone's safety, and it can lead to significant accidents. When that happens, those affected can hold those establishments accountable for their role in the victim's injuries. That's why, even though it may not ultimately be true here, it's always important to investigate what role exactly a driver's intoxication had in an accident. It wouldn't be right for someone out there to escape consequences simply because authorities weren't thorough enough.
