Commentary on Ryan Miller Accident in Milam County

If blood tests confirm the victim was intoxicated as police suspect, some may think that only means he'll be charged accordingly. However, evidence that alcohol was a factor would mean there could be other issues to address.

For one thing, charges won't help the victim get back on his feet. Any DWI crash victim, even the suspected drunk driver, deserves whatever assistance they can get with the often-hard road to recovery. Moreover, despite how harsh people can be about drunk driving there are times where these accidents aren't solely the driver's fault. That's why it's important to know about Texas dram shop law.

Under dram shop law, licensed alcohol providers who over-serve an obviously intoxicated person may be liable for injuries he causes or suffers while under the influence. A dram shop claim against a law-breaking business lets DWI accident victims seek much-needed help and makes sure that business faces consequences for endangering its customers and the public. Not every DWI crash starts with a dram violation, but the source of the alcohol is an important detail to learn when it may have caused injuries.

Despite the value and importance of dram shop law, though, police don't invest many resources in tracking down law-breaking bars. It's often better to seek proof of over-service independently with the help of experienced allies. Armed with evidence like receipts, security footage, and witness statements, many people successfully hold negligent alcohol providers accountable for the damage they helped cause.
