David Harille Killed, Driver Charged in Alleged Drunk Driving Accident on Beechnut in Houston, TX
UPDATE (July 20, 2022): Sources have identified the victim of this accident as 36-year-old David Harille.
Houston, TX -- July 16, 2022, one person was killed due to an accident allegedly involving an intoxicated driver on Beechnut.
Authorities reported that the incident happened at around 3:25 a.m. along the Southwest Freeway. It appears that a man was in a Mercury GT5 that a Mazda CV5 somehow collided with.
Reports say that vehicle continued driving off the freeway up to the 7000 block of Beechnut, off Bissonnet Street. The man reportedly approached the driver at a light. Authorities identified the Mazda driver as Elvia Castillo-Martinez. Castillo-Martinez allegedly drove away, hitting the other man in the process.
Due to the collision, the man sustained fatal injuries. Police say that Castillo-Martinez crashed some distance away from that accident scene and was ultimately arrested. Reports show pending charges for intoxication manslaughter.

It's not my place to say whether or not the allegations here are true. On the contrary, I find it's more productive to use the seemingly endless examples of alleged intoxicated driving to shed light on what can be done for the victims and families. One possible factor authorities tend to overlook, for example, is dram shop law.

If someone is illegally over-served by a bar, and that leads to someone getting hurt as a result, that bar can be liable for their role in the accident. While these reports do not specify that alcohol was involved, someone facing intoxication-related charges roughly an hour after last call certainly raises red flags one would find in many of the hundreds of cases I've handled involving negligent alcohol providers. At the end of the day, making sure all parties are held responsible should be as much a priority as getting folks the help they need. Considering dram shop can potentially do both, are steps being taken to consider that here?
