Commentary on Truck Accident on Memorial Blvd in Port Arthur
People may look at the few details of this accident and immediately point some fingers at the driver. In fairness, the most likely explanations for the accident involve one kind of driver error or another--speeding, distraction from a phone, falling asleep, intoxication...none of those have to be factors in the accident, but I have a feeling they'll all be considered by investigators.
Alcohol in particular would be a troubling factor to learn was involved--both because it would mean someone was driving while intoxicated on a weekday morning and because it would then be important to find out where the alcohol was served. Texas alcohol vendors like bars and restaurants sometimes over-serve their customers to dangerous degrees, and when that happens they can be held accountable for any damage those customers deal under dram shop law.
However, just because certain factors are common doesn't mean they can or should be taken for granted. A proper investigation will account for all the possible factors and explanations, even less-likely ones. Things like mechanical issues in the truck, tire blowouts, medical emergencies, and road hazards cause serious wrecks every single day, and every possibility deserves proper consideration.
Without careful investigation into what happened or if assumptions are made based on just the broad details at the scene, important facts may get overlooked and incorrect conclusions reached. Are steps being taken here to ensure the victims get answers?
