Commentary on Bryant Savell Accident in Wise County

If the victim's treatment records confirm he was intoxicated as police suspect, some may think that only affects his charges. However, knowing intoxication was a factor would mean there could be other issues to address.

For one thing, charges certainly won't help the victim get back on his feet. Any DWI crash victim, even a suspected drunk driver, deserves whatever assistance they can get with the often-hard road to recovery. That's why it's important the people affected by these crashes know about Texas dram shop law.

Under dram shop law, licensed alcohol providers who over-serve an obviously intoxicated person may be liable for injuries he causes or suffers while under the influence. A dram shop claim against a law-breaking business lets DWI accident victims seek much-needed help and makes sure that business faces consequences for endangering its customers and the public.

Despite the value and importance of dram shop law, though, police don't invest many resources in tracking down law-breaking bars. If one may have contributed to a victim's injuries with over-service then it's often better to seek proof of that independently with the right allies' help. Armed with evidence obtained by independent experts, many people have successfully held negligent alcohol providers accountable for the damage they helped cause.
