Commentary on Alleged DWI Accident on Madrid in Houston
Folks in Houston are no doubt used to these kinds of headlines. Anyone out and about around 2:00 a.m. is simply in danger due to the high level of drunk drivers coming home from bars. Obviously, this can result in stiff consequences for the intoxicated driver, but what about the victims? The priority should be to get them the help they need, and that process can get rather complex when it comes to alcohol. Why is that?

Essentially, Texas has dram shop law which says that an alcohol provider who over-serves an obviously intoxicated person can be liable for damages resulting from that intoxication. There are plenty of establishments throughout Harris County that care more about sales than the safety of their community or even their own customers. As such, when their actions lead to serious accidents, it's vital steps are taken to ensure the victims and families involved can confront those responsible, including any negligent businesses that need to be held accountable.
For those who have never heard of dram shop, you're not alone. It's such an important legal tool for victims and families, and it applies to many accidents. Yet authorities and even contemporaries in my field rarely take the time to explain to people the rights they have. I certainly can't say whether or not any of this applies to this specific accident, but with any crash with reports like these, it would be downright irresponsible not to consider dram shop as a possibility.
