Commentary on Justin Feliciano Accident on Kemp Blvd in Wichita Falls
Witnesses told police they saw the victim emerge from behind another vehicle into the left-hand oncoming lane as the Nissan started its turn. The Nissan's occupants told police they didn't see anything but the slower-moving vehicle in the right lane before the driver started to turn, suggesting this may have been little more than a tragic "wrong place at exactly the wrong moment" situation. A great many auto accidents fall within that category, where a moment or two could have made all the difference.

Maybe that's all the explanation there is for this incident, but I also noted in reports that police said alcohol consumption on the victim's part might have been a factor. It's unclear how they concluded that unless it was just a guess based on what happened, but if it's a genuine concern I hope they look further into it. If it turns out the rider's decisions were influenced by alcohol then any business that sold it to him may be responsible for his fatal injuries under dram shop law.
However, further investigation could also show officers' guesses about alcohol were baseless. What matters is that all potential factors are properly considered and investigated to be sure the whole truth is known. If there are any other steps to take, that would depend on what the truth turns out to be.
