Commentary on Joseph Bussard Motorcycle Accident in Arlington

Something I deal with a lot is people who will jump to conclusions at the slightest detail in these preliminary reports. For example, 2:44 a.m. is a prime time for drunk driving. That's certainly possible, given how many people are leaving bars around then. That could even lead to a bar being liable for the victim's injuries under dram shop law if the establishment over-served them.

Furthermore, a lot of people will see a motorcyclist and just assume they were being reckless. Motorcyclists get a pretty bad rap, since people just see them all as reckless daredevils who cause accidents. Again, is that possible? Absolutely, and it warrants attention just as alcohol does.

But jumping to conclusions isn't going to do any good for the people involved in crashes like this. I can't begin to count how many times even the police assumed a driver did something wrong only for our independent investigations to show evidence to the contrary. Maybe that won't be what happens here, but there's no doubt a family in need of help. That should at least warrant some prudence as more experienced investigators work to figure out what really happened here and what next steps are best for those involved.
