Commentary on Crystal Nicely Donald Moped Accident in Spartanburg

Something that got under my skin reading these reports is how buried the lead was, that is of course if the reports are accurate. Headlines said things like "moped driver killed after colliding with dump truck." Literally speaking, that's a perfectly neutral statement. But the reality is people are quick to judge drivers on things like mopeds, scooters, and motorcycles, so they tend to see that and assume the reports are blaming the victim.

That's why it's important to take reports with a grain of salt and ensure folks are getting the full story. After all, insurance and trucking companies are all too aware this negative bias exists, and they often do what they can to exploit that bias. If they were to say that a victim was speeding or that they were the one crossing the center line, for example, a jury may be more likely to believe them even without the right evidence.

As such, taking steps to ensure there are proper independent investigations can be crucial for a family looking for a resolution after such a terrible hardship. I doubt this incident would somehow prove to be the exception.
