Commentary on Pedestrian Accident on I-35 in Round Rock
It seems like there's no real telling what happened here yet, but hopefully investigators are hard at work putting more details together. Some may think there can't be that much complexity to the matter if a pedestrian was hit on a busy highway, but few accidents are really as simplistic as the news makes them sound.
Pedestrians may not necessarily belong on a highway, but that doesn't make them open season for drivers. If careful investigation found the pickup driver was doing something that prevented them from reacting appropriately, they could be responsible for the collision whether or not they had the right-of-way.

On the other side of that, if evidence shows the driver had no way to reasonably avoid the victim then it would be unfair to hold them accountable for that. There are still questions about visibility, distraction, speeding, and many other elements that need to be resolved before saying one way or the other whether the wreck could have been avoided.
I don't know better than anyone else what happened on I-35. I'm also not suggesting that pedestrians can't make mistakes or be at fault. It's just important that nobody jump to conclusions before all the facts are in. A full investigation must be conducted to be sure the victim's loved ones receive the answers they deserve.
